Sometimes our teenagers make mistakes. Properly defending an adolescent or teenager requires knowledge and experience in dealing with juvenile crimes and California law as it applies to young offenders.
In California, nearly 15 percent of those arrested are juveniles – leading to criminal charges against more than 225,000 children each year. And, while adult arrests have been in decline, the California Department of Justice reports that juvenile crimes are on the rise.
Los Angeles Juvenile Defense Lawyer Daniel E. Kann believes kids deserve the benefit of the doubt and should be allowed to enter adulthood with a clean record and a fresh start. Unfortunately, juvenile offenders are too often not given proper access to a qualified defense attorney and parents too often think juvenile crimes will not follow their children into adulthood.
Nothing could be further from the truth. Saddling a juvenile with a serious criminal record before they reach the legal age of adulthood can have serious long-term consequences. Leaving a juvenile in the system to “learn a lesson” can also be a tragically poor decision, as the child spends an increasing amount of time with young criminals instead of being shown the positive role models to which every young person should aspire.
Some juvenile crimes are not automatically sealed and can even count as strikes in adulthood, leaving little defense against a long prison sentence in the face of California’s Three Strikes Law. A juvenile convicted of a strike crime as a teenager, could face a prison sentence nearly twice as long in adulthood for a felony as simple as drug possession or a deadly car accident. Two felony convictions as an adult could result in a lifetime prison sentence.
