Oxnard Man Accused of Attempted Kidnapping at Ventura Mall

A 32-year-old Oxnard man who is awaiting trial on felony charges of committing a lewd act upon a child and luring, was recently arrested and charged for a misdemeanor offense of attempted kidnapping of a minor.

According to The Ventura County Star, the man had been loitering by a playground area at the Pacific View mall in Ventura when he allegedly asked a six-year-old girl to come with him and then attempted to grab her. The girl ran and got her father. Mall security detained the man as he tried to leave the area and called Ventura police.

According to court records, the man was taken to Ventura County jail, where he was booked for the attempted kidnapping charge. Bail was set at $1 million, according to the Star. Reportedly, the accused was set to face trial on the felony charges in late March.

A felony charge of committing a lewd act upon a child (California Penal Code 288) is a very serious felony charge that can lead to an eight-year prison sentence for one count and a lifetime registration as a sex offender if the accused is convicted.

Under California Penal Code 278, it is a violation to take a child away from his/her legal guardian when you have no right of custody over the child. That offense can be charged as a misdemeanor or as a felony. A charge of child abduction can be leveled not only if a person has physically moved a child, but also if the intention was to detain or conceal a child from his/her legal guardian.
