Increase in Domestic Violence Cases in California During The Holidays

Posted by Dan Kann | Dec 21, 2022 | 0 Comments

The holidays can be an especially challenging time for victims of domestic violence, who often feel trapped and unable to escape their abusive relationship. In California, the number of domestic abuse cases reported to law enforcement agencies has been on the rise in recent years. In addition to physical abuse, domestic violence often includes emotional abuse, sexual assault, and stalking.

Reasons for a Jump in Domestic Violence Cases during the Holidays

Stressors associated with family gatherings and increased alcohol consumption are the main reasons behind the increase in domestic violence cases in the months of November, December, and January. Tensions run high during the end of the year and stressful situations can often turn into violent ones when not well managed.

Every year in the United States, 1.3 million women are victims of domestic violence. Many incidents occur around significant holidays when financial stress leads to alcohol problems and family disputes. California Penal Code Sections 273.5 and 243(e)(1) define domestic violence and corporal injury as abuse causing pain, suffering, disability, or disfigurement to a current or past spouse, partner, fiancé, parent of one's child, roommate, or any immediate family member.

Domestic Violence Accusations

Also, for the accused, a charge of domestic violence is serious and can have lasting adverse effects on one's life. Even if you are innocent, the mere accusation of domestic violence or abuse of any kind, including Child Abuse and Child Endangerment, can have serious consequences. In addition to fines and possible jail time, a conviction of assault or battery charges can cause severe personal problems such as loss of custody rights, loss of employment opportunities, and damage to one's reputation.

If you are accused of domestic violence, you should hire an experienced Southern California domestic violence defense attorney to represent you. You need someone on your side who knows the legal process and knows how to protect you and your rights. A competent and aggressive criminal defense attorney will fight for the best possible outcome, whether that entails a reduction in charges or a flat out dismissal. And where necessary they can also negotiate for alternative sentencing, such as anger management or other programs in lieu of jail time.
