Driver to Face Felony Street Racing Charges After Monrovia Crash

Posted by Dan Kann | Nov 19, 2020 | 0 Comments

A serious crash in Monrovia occurred when a driver of a classic Mustang slammed his car into an SUV. Based on the severity of the crash and witness statements, officers believe the crash was a result of street racing. KTLA 5 News reported that a witness saw the Mustang and another car, possibly a Camaro, “just going slow, neck and neck together revving each of their engines, and then they [took] off, and they were easily going pedal to the metal."

The driver of the Mustang lost control of his car at a curve in the road and slammed into the SUV. The other car involved in the race fled the scene. Both the driver of the Mustang and the driver of the SUV were taken to the hospital with serious injuries. Photos of the scene showed the Mustang completely split in half in the accident.

Now, the driver of the Mustang is expected to be charged with felony street racing and reckless driving.

Street Racing and Reckless Driving

In California, under California Vehicle Code Section 23109(a), it is a crime to engage in a speed contest. This includes all types of motor vehicle races “against another vehicle, a clock, or other timing device.”

As seen in this case, street racing often includes a reckless driving charge as well. Under California Vehicle Code Section 23103, you can be charged with reckless driving if you drive a vehicle on a highway and intentionally drive with “wanton disregard for the safety of persons or property.”

While both these charges are typically misdemeanors, if someone is injured due to your actions, you can face felony charges like the driver in this case. This often means lengthy jail time and serious fines depending on the circumstances. If someone is killed due to your actions, this could escalate to a murder charge.
